These General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) govern the rights and obligations of the parties in connection with purchases made by any adult individual (hereinafter referred to as the “Client”) on the e-commerce website www.ma-cave-a-vin.fr (hereinafter referred to as the “Site”) operated by the company ACILYON S.A.S. (hereinafter referred to as the “Seller” or “ACILYON S.A.S.”).
The Client declares having read and expressly accepted these GTC. ACILYON S.A.S. disclaims all liability if a purchase is made online by a minor.
Any order placed by the Client on the Site implies prior and unreserved acceptance of these GTC. ACILYON S.A.S. reserves the right to modify these GTC at any time by publishing a new version on the Site. The applicable GTC are those in force at the time the Client places an order.

1.3 Ethics
ACILYON S.A.S., owner of the website www.ma-cave-a-vin.fr, is a member of FEVAD (Federation of E-commerce and Distance Selling) www.fevad.com.
ACILYON S.A.S. is committed to adhering to the general principles and rules set forth in the FEVAD codes and charters.
1.4 Confidentiality
The personal and confidential data provided by the Client when creating an account and placing an order on www.ma-cave-a-vin.fr are used exclusively for the processing of the Client’s order. These data shall not be sold or rented to third parties.
In accordance with the French Data Protection Act of January 6, 1978, as amended, the Client has the right to access, rectify, or object to the use of their personal data at any time. To exercise this right, the Client may send an email to the Data Protection Officer at: contact@ma-cave-a-vin.fr.
The Client acknowledges having read these General Terms and Conditions of Sale (GTC) available on the website www.ma-cave-a-vin.fr and, by placing an order, agrees to comply with them without reservation.
ACILYON S.A.S. reserves the right to modify these GTC at any time. In the event of a modification, the applicable GTC shall be those in force at the time the Client places the order.
In accordance with Articles L. 111-1 and L. 111-3 of the French Consumer Code, the essential characteristics and prices of the products are available on the Site at www.ma-cave-a-vin.fr.
3.1. Product Characteristics
The products offered on the website www.ma-cave-a-vin.fr, owned by ACILYON S.A.S., include wine cellars, wine accessories, charcuterie cellars, cheese cellars, cigar humidors, chocolate cellars, caviar/truffle cellars, natural cellar air conditioners, minibars, wine racks and storage units, as well as wine and champagne assortments.
All products comply with applicable French and European regulations.
All brand names mentioned on the Site are registered trademarks of their respective owners.
3.2. Product Availability
Offers are valid while stocks last. If one or more items are temporarily out of stock, we will hold the rest of your order until we can ship the complete order.
Most products are kept in stock (see indications on the product pages); otherwise, and for custom or specific products, the average delivery time is shown on the respective product page.
ACILYON S.A.S. declines any responsibility in case of product unavailability due to decisions made by manufacturers, who may modify their specifications and production without prior notice.
In accordance with Articles L.216-2 to L.216-4 of the French Consumer Code, if a product becomes unavailable, you are entitled to request a refund for your order.
3.3. Gift Vouchers
Below are the conditions for using a gift voucher. These terms apply only to vouchers issued as a 12-character promotional code:
Gift vouchers are only valid on the website www.ma-cave-a-vin.fr and cannot be used on any other site accessible from ours. They are only valid for orders placed through the cart system.
The site www.ma-cave-a-vin.fr only accepts gift vouchers it has issued.
Gift vouchers are valid for all products offered on the site www.ma-cave-a-vin.fr. However, they cannot be used to pay for shipping fees.
Gift vouchers are nominative, can only be used once, and cannot be combined with another promotional code.
If the order total exceeds the voucher amount, the user must pay the difference using one of the payment methods offered on the site. If the order total is less than the voucher amount, the difference will not be refunded.
Gift vouchers cannot be applied to orders already being processed or completed (accepted and confirmed).
Gift vouchers are valid for 6 months from the date of purchase. Once expired, they cannot be refunded (in whole or in part), nor can their validity be extended. The amount is definitively lost.
Gift vouchers cannot be exchanged for cash.
The site's General Terms and Conditions apply in full to gift vouchers.
If you offer a gift voucher to a minor, you are responsible for ensuring it is used to purchase a product appropriate for their age.
Gift vouchers cannot be sold, returned, or exchanged.
Gift vouchers are non-refundable, whether lost, stolen, damaged, destroyed, or expired.
The voucher code is only sent to the person who purchased it. Ma Cave A Vin is not liable if the code is used by a third party.
The gift voucher is a unique promotional code. It cannot be copied or used fraudulently. If fraud is suspected, ACILYON S.A.S. reserves the right to cancel the order and initiate legal proceedings if necessary.
The voucher holder is responsible for its use. They agree not to share the promotional code online; otherwise, the voucher may be voided. If a third party uses the gift voucher, ACILYON S.A.S. reserves the right to cancel the order.

After reviewing the contents of their cart and clicking the "CONFIRM MY ORDER" button during the final step of the checkout process, and by ticking the box "I have read and unconditionally accept the general terms and conditions of sale of ma-cave-a-vin.fr", the customer fully and unreservedly accepts these General Terms and Conditions of Sale.
ACILYON S.A.S. reserves the right to accept, cancel, or limit any order for reasons such as:
Suspicious or unverified billing or delivery address
Unreachable phone number
Invalid email address
Failed payment transaction
Error in product name or description
Incorrect product or shipping price
If an order is cancelled and payment has already been made by the customer, ACILYON S.A.S. will proceed with a full and immediate refund.
The collection and processing of the Client's personal data are essential for order management and delivery. Placing an order on the Site requires the creation of a customer account, where the Client’s information is securely stored and protected by a password chosen by the Client.
This information is strictly confidential and used exclusively by ACILYON S.A.S. for order processing. It is handled in strict compliance with applicable laws, notably the French Data Protection Law of January 6, 1978.
The Client has the right to access, modify, rectify, and delete their personal data at any time. To exercise these rights, the Client may:

The sale is considered finalized only upon the Client’s order confirmation and successful payment validation by ACILYON S.A.S., which reserves the right to cancel any order from a Client with a prior unresolved payment dispute.
The accuracy of the information provided during order placement is the Client’s responsibility. In case of errors in the recipient’s contact details, the Seller cannot be held responsible for any resulting delivery failure.
The electronic signature serves as proof of delivery acceptance.
The Client confirms they are of legal age and authorized to place an order on the Site.
All orders placed on www.ma-cave-a-vin.fr may be subject to prior verification and approval. As part of our online transaction security program, ACILYON S.A.S. reserves the right to contact you before processing your order to request supporting documents (e.g.: copy of ID or passport, front/back of credit card, bank statement, proof of address less than 3 months old, company registration certificate, etc.).
4.2. Order Validation at Trade Shows and Fairs
At trade shows and fairs, it is important to note that a signed order form from the client is considered firm and final. Orders placed at these events are not subject to the 14-day withdrawal period and become effective immediately upon signature of the order form.
The reference currency for payment is the euro. The product prices displayed on the website reflect the current applicable rates. These prices are billed in euros based on the rates in effect at the time of the order, subject to any typographical errors or changes in the VAT rate. The current VAT rate applied is 20%. Prices are shown excluding tax (HT) and including all taxes (TTC).
Billing is issued by ACILYON S.A.S based on the prices listed on the website www.ma-cave-a-vin.fr, and is confirmed in the order confirmation email.
On product pages, quotes, invoices, and during the ordering process, a strikethrough reference price (or RRP: Recommended Retail Price) may appear above or next to the selling price of a product or service. This reference price corresponds to the price recommended by the supplier or manufacturer for resale at the time of sale.
Payment for purchases made by individual or professional customers, whether in France or abroad, is due at the time of ordering.

6.3. Payment Methods
6.3.1. Credit Card – 100% Secure Payment
Payments are secured by Crédit Agricole. Only the bank processes card information.
Accepted cards: Visa, MasterCard, Eurocard, Carte Bleue.
Unless otherwise agreed, credit card payments are accepted up to €12,000 incl. VAT. Above this, only bank transfer is accepted. Orders are processed after payment validation.
Payments are 3D Secure authenticated for identity verification.
6.3.2. American Express
Payments via American Express are processed through a secure terminal. This method offers international payment freedom with no preset limit and full fraud protection.
6.3.3. PayPal
PayPal allows secure online payments.

Option to pay in 4 installments for orders between €30 and €2,000 (France only, subject to PayPal approval and terms)
Your financial information is never shared with the seller.
6.3.4. Bank Transfer
When placing your order, you will receive a confirmation email containing bank details for the transfer.
Your order is reserved for one month. If payment is not received within this time, the order will be canceled.
Once payment is confirmed, the order will be processed and shipped as agreed.
Note: delivery time depends on the date of receipt of your payment.
6.3.5. Financing via SOFINCO
You may request financing for your order:
4 to 6 interest-free installments OR
Financing from 7 to 60 months for products priced between €150 and €25,000
You will be redirected to SOFINCO’s secure site to apply. Approval is subject to submission of supporting documents.
The financing request is managed by SOFINCO (a brand of CA Consumer Finance). You are responsible for completing the application and submitting required documents.
Your order will be processed once SOFINCO approves your credit request.
You have a 14-day withdrawal period after signing the credit agreement.
Offer is reserved for adult individuals, subject to final approval.
Important:
Taking out a loan is a binding commitment and must be repaid. Check your repayment capacity before committing.
6.3.6. Financial Leasing
Available only to professional customers or businesses established for more than two years. Leasing is subject to approval by the financial institution.
Leasing allows companies to rent professional equipment for 13 to 60 months.

6.3.7. Irrevocable Letter of Credit
This option is available for international orders only.
Upon sale confirmation, the buyer requests their bank to pay ACILYON S.A.S on presentation of the sales confirmation. If accepted, the payment is validated and the order is shipped.
Other payment methods better suited to the customer's situation may also be offered.
7.1 Delivery Countries
We deliver to mainland France and all other countries worldwide, except the USA, Canada, and Russia.
7.2 Delivery Fees
Delivery fees vary depending on several parameters, including weight, dimensions, destination, country, and delivery method. ACILYON S.A.S reserves the right to modify these fees at any time.
7.3 Delivery Address and Accessibility
Products are delivered to the delivery address you provided during the ordering process. Shipment only takes place after full payment of the order.
Please ensure that your home’s accessibility and the product’s dimensions allow for normal delivery conditions. When placing your order, please provide all necessary information (door code, intercom, elevator code, absence of elevator and/or need for a freight elevator, specific directions, etc.) to ensure access to your home.
If delivery conditions are difficult (e.g., 5th floor without elevator, narrow stairs or elevator too small for the product, delivery requires a freight elevator, residence is in a pedestrian-only zone, etc.), we may offer a quote for specialized delivery. You may also choose this type of delivery at checkout by selecting the “Confort” delivery option (see section 7.4.3).
If you do not provide all necessary access information, a second delivery must be arranged, which may require multiple people and special handling equipment (e.g., a freight elevator), or specialized “Confort” delivery.
If you are absent on the agreed delivery date, a second delivery will need to be scheduled.
In both cases, the additional service is at your expense and must be paid before execution.
7.4 Different Delivery Methods
7.4.1 Express Delivery
For all products under 30 kg (excluding wine cellars) and accessories, delivery is within 24 to 48 business hours (excluding weekends) in mainland France for orders placed before 2 p.m.
In Monaco, Corsica, and coastal islands, delivery may take up to 72 hours. For international deliveries, the delay ranges from 3 to 8 business days.
Delivery requires a signature and is made directly to your home or workplace without appointment. If you are absent, the carrier will leave a notice with contact details and will attempt delivery the next day or leave the package at the nearest relay point for 10 days.
If not collected, the package will be returned to sender, and without your response, your order will be canceled and refunded (excluding shipping fees).
Products are delivered in their packaging. Unpacking, installation, setup, and removal of old products are not included.
7.4.2 “Économique” Delivery by One Person
For products over 30 kg, you can choose the “Économique” delivery. This can be with or without appointment if you are a professional with opening hours that allow it. Otherwise, the carrier will contact you within 48 to 72 hours of shipment (longer delays possible internationally) by phone, email, or SMS to arrange a delivery date.
Delivery occurs on weekdays (excluding weekends and holidays) between 8 a.m. and 6 p.m., by one person, at ground level in front of your home, business, or building entrance.
Products are delivered in their packaging. Stair climbing, delivery upstairs, unpacking, installation, setup, and removal are not included.
7.4.3 “Confort” Delivery with Handling by Two People
For products over 30 kg, you may select the “Confort” delivery option. This can be with or without appointment if you are a professional and your hours allow. Otherwise, the carrier will contact you within 48 to 72 hours post-shipment to schedule delivery by phone, email, or SMS.
Delivery occurs on weekdays (excluding weekends and holidays) between 8 a.m. and 6 p.m. by a minimum two-person team. Services include transport, handling, carrying upstairs, unpacking, placement in the room of your choice, delivery verification, and removal of packaging for disposal.
Assembly of shelves, accessories, and other kit products is not included.
7.4.4 “Premium” Delivery with Assembly by Two People
For products over 30 kg, you can select the “Premium” delivery option. Like “Confort,” it may be with or without appointment for professionals. Otherwise, the carrier will contact you to arrange delivery within 48 to 72 hours.
Delivery occurs on weekdays (excluding weekends and holidays) between 8 a.m. and 6 p.m. by a minimum two-person team. Services include transport, handling, carrying upstairs, unpacking, assembly and installation of the product in the room of your choice, installation of shelves/accessories, assembly of kit products, delivery verification, and removal of packaging for disposal.
This service does not include wall or floor drilling if required.
7.5 Storage Fees
If the customer requests a delivery appointment date more than 5 business days after the initial contact, storage fees of €20 per day may be charged.
7.6 Delivery Compliance
Before delivery, carefully read the reception instructions sent by email upon shipment (also available by clicking here). Failure to comply will invalidate any claims.
Beyond legal warranty (see section 10.2), you must UNPACK and INSPECT the goods even if the packaging looks intact. For “Confort” or “Premium” deliveries, unpacking is done by the carrier.
Do not sign under pressure. If not allowed to check the product, note on the delivery slip: “Driver did not allow unpacking or inspection.”
In case of non-conformity (damage, wrong product, missing item):
REFUSE the package if heavily damaged
Write clear and precise RESERVATIONS on the delivery slip (e.g., “product refused, dent on top right side,” “missing 2 shelves”)
Never write “subject to unpacking,” “packaging intact,” or “packaging in good condition.”
If you accept the goods as-is by signing, no return or exchange will be possible.
If any problem arises on delivery day, contact us immediately at +33 4 26 03 05 42 in the presence of the carrier.
You have placed an order with us, but the product(s) do(es) not meet your expectations: in accordance with Articles L.121-18 and following of the French Consumer Code, you have a period of 14 working days from the date of delivery of your order to inform us of your decision to withdraw.
You notify us of your decision to withdraw by sending the withdrawal form available by clicking here to the following email address: qualite@ma-cave-a-vin.fr. You then have an additional 14 days to return the ordered product to us. After this period, this right will no longer apply.
The product must be returned at your own expense and in perfect condition, in its original, undamaged packaging. It must not have been started up or used. It must be accompanied by all its accessories (manuals, accessories, cords, instructions for use, warranty card, etc.) so that it can be resold.
To avoid any damage related to the free circulation of refrigerant fluid inside wine cellars, please return these products upright and on a pallet. Additionally, please choose the most appropriate transport service (insurance, “fragile” option, etc.) to ensure the return of your wine cellar in perfect and resalable condition. Otherwise, Ma Cave à Vin will not be able to accept your right of withdrawal.
The refund (with return shipping costs deducted) will be made within 14 days following the receipt of your returned order at our workshops.
If your withdrawal request results from a refusal to accept delivery of your order arranged with the carrier, all transport costs related to this delivery will be deducted from your refund.
This right of withdrawal does not apply in the following cases:
For personalized products;
For spare parts and replacement parts;
For orders of personalized products, spare parts, replacement parts, or made-to-order products (such as stainless steel products, made-to-order items, with options like left-hinged doors, special colors, defined options, etc.) regardless of the brand, this right cannot be exercised in accordance with Article L120-20-2, paragraph 3 of the Consumer Code;
More specifically, for all so-called “professional” products of the following brands: AFINOX, BREMA, BRERA, CALICE, CALICE DESIGN, ELLEMME, FHIABA, G+ GRAM, HOONVED, LIEBHERR PRO, SAYL, SOBRIO, VINIBIB, WINEBAR, WINEFIT, and WINEROOM, especially for made-to-measure products;
For all professional customers;
In the case of a commercial agreement;
For private and professional customers abroad;
For professional customers who have placed orders financed by dedicated credit.
Prior to placing their order, the Customer had the opportunity to fully inform themselves about the characteristics and guarantees of the products offered on the website www.ma-cave-a-vin.fr, notably by contacting our experts directly. The customer agrees to use the products in accordance with their instructions for use.
The customer may not invoke the non-performance of the sales contract in cases of force majeure or in the event of a total or partial strike by postal services, carriers, or disasters caused by floods or fires, as well as factory closure dates of the manufacturers.
Regarding products purchased to meet the needs of the professional client, no liability will be incurred for any direct or indirect damages that may occur, such as loss of business, other damages, or various professional expenses.
9.1 Legal Warranties
9.1.1 Legal warranty of conformity
In the event of a non-conformity defect in your product, the legal warranty of conformity mentioned in articles L.217-4 to L.217-13 of the Consumer Code, and the warranty relating to defects in the sold item, mentioned in articles 1641 to 1648 and 2232 of the Civil Code, will apply in accordance with the law.
A non-conformity defect is understood in the following situations:
Your product is unfit for the usual use expected of a similar product (e.g., missing functions);
Your product does not correspond to the description given on its product sheet even if it functions perfectly;
Your product does not possess the qualities announced or agreed upon.
The legal warranty of conformity applies independently of any commercial warranty. You have 2 years from the delivery of your product to enforce this right.
This warranty applies provided the defect existed at the date of acquisition of the product, i.e., on the day of delivery.
In case of non-conformity, the product will be replaced or repaired, subject to cost conditions provided by article L.217-9 of the Consumer Code.
Transport damage is not considered a defect of conformity. The legal warranty of conformity does not apply in this case (see paragraph 8.4 Conformity).
9.1.2 Legal warranty for hidden defects
If hidden defects are found in your product, the legal warranty for hidden defects mentioned in articles 1641 to 1649 of the Civil Code will apply according to the law.
This warranty applies provided the defect(s) is(are) hidden, makes the product unfit for the intended use, and existed at the date of acquisition.
The legal warranty for hidden defects applies independently of any commercial warranty. You have 2 years from delivery to enforce this right. It is your responsibility to prove the existence of the hidden defect. To do this, you can provide various certificates or repair estimates. You can also have an amicable expert assessment performed. To find an expert near your home, you can consult the list of court-approved experts.
Under this warranty, you have the choice between 2 solutions:
Keep the product and request a price reduction,
Or return the product and request a refund of the price paid.
Transport damage is not considered a hidden defect. The legal warranty for hidden defects does not apply in this case (see paragraph 8.4 Conformity).
9.2 Additional "Serenity" warranty of 2 or 3 years Parts, Labor, and Travel

By subscribing to this warranty, you fully accept the general conditions of the Serenity Warranty.
An additional 3-year warranty following the legal warranty of conformity, called "Serenity," can be subscribed to, or is offered by Ma Cave à Vin (depending on the brands or product) at the time of order on the site. This warranty is available on certain products: see the product sheet. The warranty starts on the invoice date of your product, which serves as proof.
This warranty is also offered to clients in Belgium, Luxembourg, Monaco, and the United Kingdom.
The "Serenity" warranty does not apply to other foreign countries.
9.3 Warranty conditions
The warranty does not cover:
Aesthetic damages not affecting the proper functioning of the device unless resulting from an event covered by the contract,
Damages caused by installation not compliant with the manufacturer's instructions,
Damages caused by malicious acts, external causes to the device (shock, fall, etc.), lightning, fire, water damage, surge, misuse, or error in handling or connection,
Damages caused when devices are not transported under prescribed conditions,
Devices whose serial number has been removed, altered, or made illegible,
Damages involving the responsibility of a third party or resulting from intentional or fraudulent fault,
Maintenance costs and repairs carried out by third parties not authorized by our warranty company or manufacturer,
Travel expenses following an unjustified intervention request,
Labor related to parts not covered by the warranty contract,
Replacement of consumable and/or wear parts (bulbs, LED lighting, door seals, locks, filters, batteries, door handles, etc.),
Failures related to accessories such as power cables, rubber parts, glass parts, plastic parts, shelves,
Replacement of glass parts and panes,
External parts: paint, varnish, handles, rollers, adjustable feet, etc.,
Dents, shocks, oxidation, smoker’s accidents,
Simple adjustments and routine maintenance,
Contents of the devices,
Connection cables and any related material or immaterial damages,
Damages to all built-in products for which installation instructions were not respected, such as minimum dimensions not respected, nonexistent or insufficient air column (missing ventilation grid, lack of air evacuation at front or top, etc.).
In all these cases, intervention and repair costs remain the customer's responsibility.
Note that no request for order cancellation, refund, or replacement with a new product will be accepted during the period of handling of the breakdown by the after-sales service (intervention at the client + parts order, or factory return + repair + product return).
Attention: Your warranty contract is nominative and non-transferable.
9.4 TOTAL LOSS – Product depreciation
In the event of a total loss during the warranty period, meaning the device is not repairable or its value, after depreciation, is less than the cost of repair, compensation is made by a voucher calculated on the day of the non-repairability certificate issued by the technician, based on the initial purchase price minus a depreciation of 1% per month from the invoice date.
The voucher is valid exclusively on the website www.ma-cave-a-vin.fr for 6 months.
There is no refund in case of total loss.
9.5 Warranty exclusion: ten-year warranty
Excluded from the installation services of products sold by ACILYON S.A.S are all electrical, masonry, etc., works subject to ten-year liability. Electrical supply, kitchen furniture, and built-in niches must be installed, adapted, and/or operational before the arrival of installers.
9.6 Limitation of liability
In the event of deterioration, partial or total breakdown of a device, ACILYON S.A.S cannot be held responsible for the contents stored inside the devices (e.g., wine, alcohol, champagne, cigars, charcuterie, cheeses, chocolates, etc.). The customer cannot claim any compensation regardless of the reason. However, it is advisable for the customer to subscribe to insurance to cover, in the event of damage to electrical appliances, the contents stored inside the products sold.
ACILYON S.A.S cannot be held liable to the customer or any third party for any direct or indirect damage, loss of profit or revenue, or loss of data that occurs in any way. Similarly, the total or partial impossibility to use the products, notably due to hardware incompatibility or non-conformity to the Customer's needs, cannot engage ACILYON S.A.S’s liability nor give rise to any right to damages or product refund.
In case of a dispute or complaint, the Client is advised to contact Customer Service at +33 (0)4.26.03.05.43 to seek and find an amicable solution.
In accordance with the provisions of the Consumer Code regarding the amicable resolution of disputes, ACILYON S.A.S is a member of the Mediation Service of the E-commerce Federation (FEVAD), whose contact details are as follows:

Failing an amicable agreement, any dispute related to this contract will be exclusively submitted to the Commercial Court of Lyon, France. This jurisdiction also applies to summary proceedings.
The seller retains ownership of the goods until full payment of their price is received. In the event of non-payment by the agreed deadline, the seller may reclaim the goods; the sale will be automatically terminated at the seller’s discretion, and any deposits already paid will be retained by the seller as compensation for the use of the goods by the buyer.
